1. Agreement Precedence

If you have signed, electronically accepted, or otherwise agreed to a Service Agreement, Consulting Agreement, Master Services Agreement, Coaching Agreement, Client Services Agreement, order form, invoice, payment authorization, or other written agreement with MLEC, that agreement may contain additional privacy, confidentiality, data use, payment, financing-related, recording, or service-related terms.

If there is a conflict between this Privacy Policy and an applicable agreement with MLEC, the applicable agreement controls as to the specific Services purchased or provided, unless otherwise required by applicable law.

If you separately enter into a financing agreement with a third-party lender, financing provider, or financing platform, that third party's privacy policy, financing agreement, disclosures, and other applicable terms govern how that third party independently collects, uses, stores, shares, or otherwise processes information in connection with its financing services.

MLEC does not control the independent privacy practices of a third-party lender or financing provider.

We may collect personal information, business information, non-personal information, technical information, payment-related information, financing-related information, communications, and other information you provide or that is generated when you interact with our Services.

MLEC does not make representations that it receives or maintains all information provided by you directly to an independent financing provider.

5. Artificial Intelligence Processing

We may use artificial intelligence tools to assist with research, drafting, analysis, workflow automation, meeting summaries, educational content, templates, client support, internal operations, and service delivery.

When using AI tools, we may process information you provide, information related to your business, session notes, prompts, documents, or other service-related content as reasonably necessary to provide Services, improve efficiency, summarize information, or create deliverables.

We aim to use reasonable care and limit information shared with AI tools to what is appropriate for the intended purpose.

AI output may be reviewed, edited, and used by MLEC.

AI output is not legal, tax, accounting, financial, clinical, medical, human resources, insurance, lending, credit, or professional licensing advice.

You are responsible for reviewing applicable outputs and consulting qualified professionals when appropriate.

Third-party AI providers may process information according to their own terms and privacy policies.

Unless specifically requested through an authorized process, you should not submit Social Security numbers, complete bank account information, complete payment card numbers, medical records, protected health information, or other highly sensitive information into MLEC AI tools, chatbots, general email, SMS, communities, or other general communication channels.

6. How We Share Information

We do not sell personal information for money.

We may share information with third parties that help us operate our business, administer transactions, or provide Services, including:

Underwriting;

Credit inquiries;

Financing eligibility standards;

Interest rates;

Fees;

Financing terms;

Repayment terms;

Account servicing;

Collection activity;

Credit reporting;

Identity verification practices;

Information retention practices; or

Other lender-controlled activities.

Your interactions directly with an independent lender or financing provider are also governed by that provider's applicable terms, disclosures, and privacy policy.

We encourage you to review those policies and agreements before submitting information or entering into a financing arrangement.

8. Marketing Communications, Email, and SMS

By providing your email address, phone number, or other contact information, you may receive service-related, administrative, billing, financing-related, legal, security, and marketing communications from MLEC, subject to applicable law and any required consent.

You may opt out of marketing emails by using the unsubscribe method included in the communication or by contacting us.

You may opt out of SMS marketing by following the opt-out instructions included in the message, such as replying STOP where applicable.

Please note that opting out of marketing communications does not necessarily prevent us from sending non-marketing communications related to:

An active purchase;

Account administration;

Billing;

Payment status;

Authorized payment arrangements;

Financing administration;

Security;

Legal notices; or

Other transactional or service-related matters where permitted by law.

Communications sent directly by a lender or financing provider are governed by that provider's own terms, privacy practices, consent requirements, and applicable law.

9. Recordings, Transcripts, and Meeting Summaries

Meetings, webinars, coaching sessions, consulting sessions, trainings, workshops, live events, group calls, and other program activities may be recorded, transcribed, summarized, or otherwise captured for educational, training, quality assurance, internal, documentation, replay, or program delivery purposes.

By attending, participating in, speaking during, appearing on video, submitting questions, or otherwise joining a recorded session or event, you acknowledge that recording, transcription, summary, capture, storage, and use may occur as disclosed or permitted by applicable law.

We may use artificial intelligence or third-party tools to help transcribe, summarize, or organize meeting content.

10. Confidentiality and Client Information

We use reasonable care in handling confidential business information you provide in connection with our Services.

We may use general, non-identifying information, lessons learned, trends, scenarios, or teaching points for educational, training, marketing, or business purposes, provided that we do not disclose your full name, business name, image, voice, screenshot, or other clearly identifying information without prior written consent, unless otherwise permitted by an applicable agreement or law.

If you participate in group coaching, communities, live trainings, events, or other group settings, information you voluntarily share may be heard, viewed, discussed, or responded to by MLEC and other participants in that setting.

You are responsible for deciding what information you voluntarily share in group spaces.

11. Financial and Sensitive Information

Certain transactions, including third-party financing, may require sensitive financial or identity-related information.

Whenever possible, highly sensitive information required by an independent lender, financing provider, or payment processor should be submitted directly through that provider's authorized and secure process rather than through MLEC's general email, SMS, community, chatbot, or other general communication channels.

Depending on the applicable transaction and authorization, MLEC may receive or process certain payment or financial information necessary to administer an authorized payment arrangement.

We do not intentionally request that you send complete credit card numbers, Social Security numbers, complete bank login credentials, or other highly sensitive financial credentials through ordinary email, SMS, community posts, or general website communications.

If sensitive information is required for a specific transaction, you should use the designated secure process or platform provided for that purpose.

12. Data Retention

We retain information for as long as reasonably necessary to:

Provide Services;

Manage accounts;

Complete transactions;

Administer payments;

Administer financing-related transactions;

Maintain transaction and funding records;

Maintain business records;

Satisfy accounting and tax requirements;

Comply with legal or contractual obligations;

Resolve disputes;

Address chargebacks or financing disputes;

Enforce agreements;

Prevent fraud;

Protect intellectual property; and

Support legitimate business purposes.

Retention periods may vary based on:

The type of information;

The Service provided;

The transaction involved;

Payment or financing requirements;

Legal requirements;

Accounting or tax obligations;

Contractual obligations;

Information maintained independently by a third-party lender, financing provider, payment processor, or other service provider is subject to that provider's own retention practices and legal obligations.

When information maintained by MLEC is no longer reasonably needed, we may delete, de-identify, aggregate, archive, or securely retain it as permitted or required by applicable law and legitimate business needs.

13. Security

We use reasonable technical, administrative, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, loss, or destruction.

Safeguards may include:

Access controls;

Secure third-party platforms;

Authentication controls;

Encrypted communications where available;

Vendor safeguards; and

Internal procedures.

No method of internet transmission, electronic storage, platform hosting, email, SMS, payment processing, financing platform communication, or digital communication is completely secure.

We cannot guarantee absolute security.

You are responsible for using secure devices, protecting your login and account credentials, using designated secure payment or financing platforms, and notifying us promptly of suspected unauthorized access involving your MLEC account or information provided to MLEC.

Security incidents involving an independent lender or financing provider should also be reported directly to that provider.

14. Security Incidents

If we become aware of a security incident involving personal information maintained or controlled by MLEC, we may investigate, take appropriate steps to address the issue, notify affected individuals or authorities when required by applicable law, and cooperate with service providers or legal advisors as appropriate.

Not every security event constitutes a legally reportable breach.

Notice, if required, will be provided in accordance with applicable law.

Security events involving systems controlled independently by a lender, financing provider, payment processor, or other third party may be handled by that provider according to its own legal obligations and policies.

15. Your Privacy Rights and Choices

Depending on your state, country, and applicable law, you may have certain rights concerning your personal information.

Unless expressly requested through an authorized process for a specific Service or transaction, you should not submit highly sensitive information through our general websites, forms, portals, communities, email, SMS, chatbots, or other general communication channels.

Highly sensitive information may include:

Protected health information;

Biometric identifiers;

Social Security numbers;

Complete government identification numbers;

Complete payment card numbers;

MLEC does not intentionally collect biometric data for identification purposes through its public website.

If biometric information is ever collected for a specific Service, event, security feature, or platform, any notice or consent process required by applicable law will be provided.

MLEC is not a healthcare provider and does not provide medical care.

Our Services generally consist of business education, consulting, coaching, licensing guidance, and related business support.

If you provide health-related or other sensitive information, you represent that you are authorized to provide it.

19. Children and Age of Consent

Our Services are intended for adults who are at least eighteen (18) years old.

We do not knowingly collect personal information from children under thirteen (13).

21. Business Transfers

If MLEC undergoes a merger, acquisition, restructuring, sale of assets, corporate financing transaction, transfer, or other business transaction, information may be transferred as part of that transaction.

Any successor or acquiring entity may continue to process information in accordance with this Privacy Policy unless otherwise stated or required by applicable law.

For clarity, the term "financing" in this Section refers to financing or investment involving MLEC itself and is separate from consumer or client financing used to purchase MLEC Services.

When material changes are made, we may post the updated Privacy Policy on our website or provide notice by another reasonable method as appropriate.

Unless otherwise stated, changes become effective when posted or on the effective date identified in the updated policy.

The Privacy Policy applicable to a particular transaction may also be subject to an applicable Service Agreement, financing documentation, payment authorization, or other agreement.

Where required by applicable law, changes will not retroactively reduce rights that cannot lawfully be modified without additional notice or consent.
